概要：世界の憲法には「民族」や「民族主義」を正面から規定する憲法もある。他方、日本国憲法は「民族」について沈黙する、市民的な憲法だと理解されている。しかし、憲法制定の経緯をみると、その沈黙は無関心を意味していなかったことが分かる。国籍法や入管法と一体となったその後の憲法の運用も民族主義的な限界を帯びている。外国籍者の公務就任権問題などをてがかりに、その限界を乗り越えていく方法について議論したい。
