概要：死刑存置論に強力な論拠を提供してきたのは、哲学者カントの議論です。「正義」の理念は「均等性」であり、「殺した者は殺されねばならない」という「同害刑法」（タリオの法）こそが、あらゆる相対性を超えて妥当する正義の原理だというのです。これをめぐって議論します。
